1. Acceptance of Terms

By clicking “Install”, accessing the GoFitment app, or using any part of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Description of Service

GoFitment is a Shopify application that provides Year, Make & Model (YMM) fitment search functionality for Shopify-based wheel and tire stores. The App includes:

• A customizable YMM search widget for your Shopify storefront.
• CSV and FTP-based fitment data import and management tools.
• An intelligent fitment mapping engine that links vehicle data to Shopify product variants.
• A dashboard for managing fitment records, sync schedules, and analytics.

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

3. User Responsibilities

As a user of GoFitment, you agree to:

• Maintain accurate and current information in your Shopify store and GoFitment account.
• Ensure that all fitment data you upload or import is accurate, legally owned or licensed, and does not infringe upon the intellectual property rights of third parties.
• Not use the App for any unlawful purpose or in a way that violates Shopify's Partner Program Agreement or App Store Terms.
• Not attempt to reverse engineer, decompile, or extract the source code of the App.
• Not introduce malicious code, conduct denial-of-service attacks, or otherwise interfere with the App's infrastructure.
• Keep your Shopify store credentials and GoFitment account credentials confidential.

You are solely responsible for the content and accuracy of all fitment data you upload to the App.

4. Payment & Billing

Free Trial: All paid plans include a 14-day free trial period. No credit card is required to start a trial. At the end of the trial, you will need to select a paid plan to continue using GoFitment beyond basic features.

Subscription Plans: GoFitment is offered on a monthly subscription basis through the Shopify Billing API. Charges are billed through Shopify and appear on your Shopify invoice.

Pricing: Current pricing is listed on the GoFitment app listing on the Shopify App Store and at gofitment.com. We reserve the right to change pricing with 30 days' notice.

Taxes: Applicable taxes may be added to your subscription charge depending on your jurisdiction. Tax calculation is handled by Shopify's billing system.

Refunds: Charges processed through Shopify's billing are generally non-refundable, except where required by law or at our sole discretion. If you believe a charge was made in error, contact us at info@webdevarif.com within 14 days of the charge.

5. Cancellation Policy

You may cancel your GoFitment subscription at any time by uninstalling the App from your Shopify store. Upon uninstallation:

• Your subscription will be cancelled at the end of the current billing period.
• You will retain access to the App's features until the end of the paid period.
• Your fitment data and settings will be deleted from our servers within 30 days of uninstallation, unless you request earlier deletion.

We reserve the right to terminate or suspend your account for violation of these Terms, with or without notice.

6. Intellectual Property

Our IP: All code, design, trademarks, logos, and content comprising the GoFitment application are the exclusive property of WebDevArif. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your internal business purposes during your active subscription.

Your Data: You retain all rights to the fitment data, product information, and other content you upload to GoFitment. By uploading data, you grant us a limited license to process and store that data solely for the purpose of providing the App's services to you.

Feedback: Any suggestions, bug reports, or feature requests you submit may be used by us to improve the App without any obligation to you.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any fitment data processed through the App.

Your use of the App is at your sole risk. We are not responsible for any damages to your store, products, or business resulting from fitment data errors or App malfunctions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEBDEVARIF, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS GOODWILL.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so the above limitation may not apply to you.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms at gofitment.com with a new “Last Updated” date.
• Sending a notification through the GoFitment app dashboard.
• Emailing the Shopify store owner email on file (for significant changes).

Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. For international users, we comply with applicable local laws to the extent required.

Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable rules.

Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief where necessary to prevent irreparable harm.
